Terms of Service
These terms govern your use of HomeServiceReply (the "Service"), operated by Justin Karahan (the "Provider", "we", "us"). By creating an account, joining early access, or using the Service, you ("Customer", "you") agree to these terms. The Service is intended for businesses, not consumers.
1. The Service
HomeServiceReply detects calls your business does not answer and sends an automatic text message back to the caller, then uses an automated assistant to qualify the enquiry and help book an appointment. The Service is offered on an evolving, early-access basis. We do not guarantee any specific number of recovered calls, bookings, or revenue.
2. Accounts and eligibility
You must be at least 18 and authorised to act for the business you register. You are responsible for the accuracy of your information, for your account credentials, and for all activity under your account.
3. Acceptable use
You agree not to use the Service to send unlawful, deceptive, or unsolicited messages, and to comply with all laws that apply to your communications, including telecommunications, anti-spam, and data protection rules. You are responsible for having a lawful basis to contact the people who call your business and for the content you configure the Service to send. You may not attempt to disrupt, reverse engineer, or misuse the Service.
4. Your setup and responsibilities
You are responsible for configuring call forwarding, your greeting, services, prices, and availability. You decide which messages are sent and remain responsible for confirming and honouring any appointments. You must review automated bookings; automated systems can make mistakes.
5. Plans, fees, and billing
During early access the Service may be provided free of charge. When paid plans are introduced, fees, billing cycles, trials, and taxes will be presented before you subscribe. Subscriptions renew for the chosen period unless cancelled before renewal. Messaging and telephony usage may carry costs that are described in your plan. Statutory withdrawal rights, where they apply, remain unaffected.
6. Data protection
Our handling of website data is described in the Privacy Policy. Where we process personal data of your callers on your behalf, you act as controller and we act as processor under the Data Processing Agreement, which forms part of these terms.
7. Third-party services
The Service relies on third parties for telephony, messaging, calendars, and artificial-intelligence processing. Your use may be subject to their terms, and their availability is outside our control.
8. Intellectual property
We and our licensors own the Service, including its software, design, and brand. You retain ownership of your business data and the content you provide. You grant us the rights needed to operate the Service for you.
9. Disclaimers
The Service is provided "as is" and "as available" to the extent permitted by law. We do not warrant that it will be uninterrupted, error-free, or that automated replies and bookings will always be accurate or complete.
10. Limitation of liability
We are liable without limitation for intent and gross negligence, for injury to life, body, or health, and where mandatory law (for example product liability) provides. For slight negligence we are liable only for breach of a material contractual obligation (an obligation whose fulfilment makes proper performance of the contract possible and on which you may regularly rely), and such liability is limited to the foreseeable, typical damage. Any further liability is excluded. These limits also apply in favour of our staff and subcontractors.
11. Indemnity
You will indemnify us against third-party claims arising from your unlawful use of the Service or your breach of these terms, including claims relating to messages sent on your instruction.
12. Term and termination
You may stop using the Service and close your account at any time. We may suspend or terminate access for breach of these terms or where required by law. On termination, the data-handling provisions of the DPA apply.
13. Changes
We may update the Service and these terms. We will post the current version here and, for material changes affecting paid customers, give reasonable notice.
14. Governing law and jurisdiction
These terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is [your city], Germany, where permitted by law. Mandatory consumer protections of your country of residence remain unaffected.
